Hi,

I am working in an MNC and I handle PF in my office.

My query is regarding the different types of employees we have in our office: contract employees and regular employees. One employee was promoted this month. However, during the contract period, the employee is not eligible for PF and ESI. Only when they are promoted to a regular employee status do they become eligible for PF and ESI.

The issue we are facing is that a contract employee was promoted to regular employee status this month, but the employee is currently in the US and has not even filled out the necessary forms. If any problems arise in this case, are there any other ways to fill out the forms?

Dear,

PF regulations do not differ between regular and contract employees. It states that contributions should be made from the first day as per the eligibility criteria stated in the PF Act. In the case of contract employees, the contractor is responsible for every employee, whether contract or regular, while the principal employer is also responsible. Please consider this aspect.

Secondly, as they are eligible for PF contributions, please send the necessary information in the required format with the contributions. The nomination forms can be downloaded from the internet and sent by the employee via courier for submission.

Provident Fund Registration and Deductions Query

I am an HR professional at an IT company and have a query regarding the provident fund. Our company did not have a PF registration number previously. Last year, in October, there was a PF investigation in our office, leading us to register our company under PF rules. The PF officials, during the investigation, temporarily seized some pay slips and issued a notice to register sixteen employees under PF norms.

The issue now is that six of these sixteen employees have already left the company in December. How can we register these resigned employees under PF? Please suggest the best approach to take. Also, from which month should we start implementing PF deductions?
