Hi,

If the employee is covered under ESI, then she will be entitled to benefits as per ESI rules. If not, she will receive benefits under the Maternity Benefit Act, 1961, where the employer will be responsible for providing the benefits.

Our team members are very correct. If the employee contributes to ESI (minimum 9 months), they will be eligible to receive Maternity Benefits from the ESI office. If not, we have to provide them. Please try to obtain it from ESI.

Yes, she is covered under the ESI Act. She will be receiving benefits from ESI. Otherwise, the employer will provide leave salary under the Maternity Benefit Act.

12 weeks of leave are allowed for maternity leave, both before and after 6 weeks of delivery.
