Respected senior members, I would be grateful if you could help me with this situation. I was working for a well-known BPO in Bangalore for over 5 years. People in the office knew that I was experiencing some health issues. I sent my resignation through email before any complications arose, but no one ever got back to me regarding my letter. I thought that since some major changes were happening in the process, perhaps my RM wouldn't have noticed my letter.

One day when I was at work, I fell ill and asked my RM to take me to the hospital. The RM directed me to HR. Before I could reach his desk, he just asked me to go home despite my terrible pain. I left the office, and the very next day, I was hospitalized. My relatives tried calling my RM many times to keep him informed. By the time they were able to reach him, he informed them that I was terminated for not returning to work.

After taking some rest, I returned to Bangalore to speak to my managers. Unfortunately, the process was shut down. Meanwhile, I tried talking to HR, who was the same person who sent me home instead of to the hospital. I spoke to him, and he said everything is over, and nothing can be done. Since this is my first job, I am unable to move on without papers. I really don't know what to do. I'm still recovering physically, but mentally, I'm very distracted.

I do have the screenshot of the resignation email which I sent to my RM.

Please help me on how to handle this situation with my old employer.

Thanks in advance.

Resignation submitted by email is not valid because anyone can create an email ID and send a resignation. In case you have sent it by email, please send a confirmation copy by registered post. I think the company has decided to terminate you. If you do not wish to serve anymore, please request to collect your dues and relieving letter, etc.

I am not able to understand your issue as to what you are looking for. Also, when you describe things, please try to use commas and full stops; it's so difficult to understand. But anyways, even if they have terminated you, they must have issued you some letter (termination letter, full and final letter, etc.). If they haven't, then please ask them for the same. As you worked there for 5 years, tell them that you would pay for the notice period, and then they can issue you the relieving letter. Also, if you have sent them the resignation letter, show it to them. Was it from your personal email or official email? All you need to do is meet the HR head or your PM there. You would need to visit there often to get the work done. Be polite with them, and sooner they would definitely issue you the respective letters.

Cheers.

Hi, could you briefly explain what you are looking for? Are you seeking experience and relieving letters from that company? Or are you looking for a job in the same office?

Thanks for your reply regarding this concern. You are right; I just want to obtain experience and a relieving letter from that company. Due to my health issues, I will not be able to work for the next 2 to 3 months. Since this was my first job, I am a little scared that I will not be able to move on.

Regards.

You should talk to the HR Head of your previous employer and discuss your resignation and the incident that occurred. Make sure to bring along relevant medical proofs.

Moreover, you can review your appointment letter to check the terms and conditions of termination, specifically if there is a provision for the company to pay the notice period.

If the company is not compensating you, you have the right to request a full and final settlement letter or a termination letter in this scenario. No company can refuse to provide you with a full and final settlement. Additionally, since you have completed 5 years of service, you can also inquire about gratuity from the company.

Steps to Address Employment Dispute

Approach the Local Labour Department to raise a dispute. Also, send a letter indicating that you are taking this step as no one is responding. Make sure to mark a copy to the Managing Director of the company. Insist to the labour authorities that you want the matter to be referred to court.

If you can find a good advocate, engage their services. It might require spending some money, but they will likely help you settle all your dues along with obtaining certificates.

Dear itzmegeek,

Sorry to hear this from your end. I can clearly understand that even though you have submitted papers, they terminated you. Kindly check with HR about your Experience Certificate, Relieving Order, F&F, and PF. Kindly ensure your notice period pay is raised from your end if required. Please let me know whether you were terminated due to health issues or some other reasons.

And advanced wishes for your career.

Please consider my suggestions:

Just as you have reported the details of the incident, put the same report with the printouts of the communication you had with your RM, Manager, and HR in a letter and send it to your employer through a registered post.

You don't have any data on the communication and response from your office while your relatives were trying to reach your Manager when you were admitted to the hospital. All you have is the document from the hospital, which explains the medical reasons for the absence from work.

Draft your letter with all these details and request the employer for a release of your documents. Offer them any support they might need, up to buying out of the notice, if need be. However, your medical reasons should waive the need for a buy-out. Request them on medical grounds and offer every document and contact they might need to investigate, if at all.

Mention an end date within which they need to respond; no response would declare and escalate the matter to the next level.

In case they don't, this letter itself remains a communication to your employment with this firm.

Regards.
