Please could somebody help me. We are a service-oriented organization. We have received a resignation letter after one year from an absconding executive leaving the organization. The reason he has now approached us is because his current employers are not taking him. What is the normal course of action to be followed in such cases.

Dear Dwipna,
Generally, the company takes the following actions if the employee is absconding without submitting a resignation or without fulfilling the mandatory relieving formalities:
1. Notice is to be served for clarification of absconding.
2. If the employee doesn't reply, then you can claim for compensation which caused a loss to the employer in his absence.
You can take legal action as per the company rules and regulations.

This is the practice that we are currently following. However, in this case, he had just disappeared about a year ago without any information after receiving his salary. The HR department has been established in our organization for only the past year.

In the case where an employee is returning to us after one year, what I suggest can be done is to issue a backdated letter with the last working day date and complete the Full and Final formalities. This solution is straightforward.

The number of executives who abscond is on the rise. They just wait for the salary and disappear. Do we, in the HR fraternity, want to encourage this practice?
