Maximum Age Limit for Hiring Employees
What is the maximum age limit to hire an employee? Can we hire a candidate who has crossed the retirement age (60 years as per the act), and will they be eligible for ESIC and PF contributions? Please suggest.

In general, the retirement age would be 58 or at most 60. After that, if you want to continue his services, then it is better to deploy him on a consultant basis. After 60, no PF should be deducted, and I don't think that his/her salary will be less than Rs. 15,000. Hence, ESI also applies.

Thank you for your reply. I understand that we must deploy the employee who crosses the retirement age and take him as an off-role employee (like a consultant). Even when I checked with some of the legal advisors, some of them say yes, and some of them say no. If there is any reference available, it would be very helpful to me. If you have any reference documents, kindly share them.
