I have submitted my resignation with a 20-day notice period, contrary to the 90-day notice period outlined in my appointment letter. The resignation was sent via email, and a hard copy was also submitted. Despite a polite reminder to my reporting manager and the Manager of HR, we have only received a response indicating the requirement of a 90-day notice period.

As per the appointment clause, I am obligated to serve the full 90-day notice period. However, due to health issues, I am unable to continue working the full notice period and can only serve 20 days.

I seek your guidance on how to proceed in this situation. I am concerned about the possibility of the company taking legal action against me.

Dear Balamurugan,

You will need to pay for another 70 days to receive your relieving letter from the company. Alternatively, check with your HR to see if they are willing to deduct your paid leaves against the notice period. In this case, you would then have to cover the remaining days to obtain your relieving letter.

If you do not serve your notice period and leave the organization without prior notice, it will be considered as absconding. Some companies may classify such cases as absconding post-resignation, leading to a termination letter.

It is advisable to settle the balance for the days and update the resignation type to normal so that all other processes can proceed smoothly.

I absconded 3 months ago. I don't know if they have recorded it as abscondence. If it has been noted as abscondence, will I still be able to obtain a relieving/experience letter?
