I am IT engineer and as per my epoiment letter it is clearly mentioned to serve one month notice period after resignation. I have resigned and in my resignation letter I have given the notice period of one moth mentioned last date also. After resignation my reporting manager is not replying. It is almost 20 days and I have sent 4 to 5 follow up mails but still he is not accepted my resignation and no reply.
When I have called he is not giving me proper answers. Company had sent one person for the handover of my responsibilities and I am doing the same. Soon I will send the handover completion mail.
My problem is if still they not provide me the releaving letter then what I can do on my last working day. One more last thing I am in probation period.

if you have not given notice period your organization doesn't have a right to withold your experience letter if you have paid them the due amount of notice period if you have given notice period then also they don't have right to hold your expereince and relieving letter. Would suggest you to please speak to your HR team face to face and get an idea as to why they are holding your experience and relieving letter.

I need a professional / legal opinion on this scenario.
An employee resigns and requests his employers to relieve him early, stating his willingness to pay the penalties in lieu of notice period. He also has explained his constraints why he cannot extend the notice period, which is 30 days from date of resignation. The employers have accepted his resignation, but haven't confirmed him the date of relieving, yet, and still are negotiating with him to extend, which he cannot accept due to his constraints. In these circumstances -
1. Does the employee have the right to demand release on a certain date on payment of all penalties and dues?
2. Does the employer have any right to make the employee stay longer?
3. Is the employer liable to face any legal risk from the employee?
The appointment letter states that either party can terminate the employment by giving one month notice or notice pay (salary) in lieu.
Kindly advice asap.

My friend has recently got an excellent offer and is required to join in a weeks time. The problem is that he has resigned and has requested his manager to waive of the notice period and relieve him on an early date. The manager has accepted the resignation but is not giving any confimation on an early relieving date. My friend is willing to pay for the NP shortfall also. i also would like to add to this that my friend is facing strong mental harassment by his current manager and he is threatening to ruin the career in case my friend reports this matter to HR or anyone else.
