If the establishment area is covered under ESI then WC cannot substitute ESI. In the absence of ESI WC will prevail.

If my registered office is covered under the ESI Act, and I open branches both outside and inside states in India employing fewer than 10 employees, is ESI applicable as in my other plants?

Hi, please clarify the following: Our contractor at our warehouse located in the state of Orissa has informed us that the area where our warehouse is located is not a notified area as per the ESI Act, and hence he has opted for Workmen's Compensation insurance. My organization, located in Andhra Pradesh, is covered under the ESI Act. In view of this, is it mandatory that our warehouse contractor has to opt for ESI even though the warehouse locality/area is not notified?
