We have fewer than 10 employees at the registered office location, which is not covered under the ESI applicability region, but more than 10 at the other office where ESI is applicable or in an area covered under ESI. Will ESI be applicable to our employees?

If your company is covered under the provisions of the ESI Act at one place and your registered office is situated in an area that is not notified under the provisions of the ESI Act, then it is not required for the management to cover their registered office with the ESI authority. If the above area is notified under the provisions of the ESI Act for the purpose of ESI coverage, then your registered office will automatically be covered along with your other office if the company name is the same.

Thank you for your response. I would like to inquire whether the other offices would also need to comply with the ESI Act in the first scenario. Is it a requirement that only when the registered office is covered, the act is applicable to other locations as well? Kindly provide clarification.

Can you please tell me if we have 19 employees here in a software company that was established in March? Our 11 employees' salaries are more than 15,000k (Gross salary), and the remaining 9 are getting below that amount. In these conditions, I have four questions:
1. Is it mandatory to register with ESIC as a software development company?
2. If yes, please suggest the procedures for an old company to get registered in ESI.
3. Is there any penalty for not doing it until now? If yes, how much?
4. How long will it take to get registered? Can we do it online? (Please provide formalities.)
