Dear Seniors,

Could someone explain the following statement to me, which states that:

"Failure to rejoin duty on completion of Maternity Leave, except for good and sufficient reason acceptable to the company will cause the female employee to lose her lien on her appointment. In such event she will automatically be deemed to have resigned from the services of the Company and her service may be terminated at the sole discretion of the Company"

How much time can we provide to an employee who is asking for long paid/unpaid leaves after completion of maternity leave from the employer? From the employer's perspective, we cannot allow long leaves after maternity leave due to the company's requirements. Can someone suggest how many leaves can be given immediately after maternity leave to an employee? Additionally, if an employee wants to take long unpaid sick leave, what can the company do?

The rule varies in different countries and states. In Dubai, it is 100 days of unpaid leave after maternity, provided there's a valid medical report explaining the reason for the same. In cases where the employee is eligible for annual leave, provision can be made to combine both maternity and annual leave. In that case, the employee has to return to work as soon as the leave period ends. Failure to do so may result in termination at the sole discretion of the company.

Hi Tapan,

There is no such limit, as per my knowledge. It's at the discretion of the company to sanction leaves after maternity leave is over. It can be for a month or two more. I have seen many companies giving leaves (non-paid) to their employees for three more months on medical grounds if the employee has valid medical reasons. Also, you have to decide based on the kind of job she is doing in the organization, how critical this position is... all these aspects are kept in mind before sanctioning the leaves.

I have been working with my current firm for the past year. After my maternity leave, I returned to the office after three months. However, a new person was hired within five days, and after just one month of my return to the office, I was given a notice to leave the job.

Please advise me on my rights.
