Navigating Relieving Letter and Exit Formalities in Employment - CiteHR

Hi, I am from Chennai and am writing on behalf of my brother who is currently working abroad. He was working in Bangalore as a contractor for a reputed software company for 2 years and quit in October 2010. His resignation was accepted by HR with a 30-day notice period. The issue is they did not recruit a backup for my brother during his notice period. Since he needs to join a new company, he has left the current company. My brother has spoken to them several times about his relieving letter, but there has been no proper response. He has sent emails to HR and the manager of the consultancy, who is causing problems in providing his relieving letter. When we called and checked, he says exit formalities need to be completed and speaks very rudely.

Request for Assistance with Relieving Letter

Can you please suggest what can be done now? A relieving letter is mandatory for my brother's new job abroad. Can I complete the formalities on behalf of my brother with a signed letter from him? Please help as this is urgent, and I am writing for the sake of my brother's career.

Hope your brother has received the resignation acceptance letter. Please have him send an email to the concerned HR, with a copy to you, informing them that his sister will complete all exit formalities as required. Please note that in such situations, maintaining good relations and persuasion are key. Since the relieving letter is needed urgently, please handle the issue delicately and smoothly. Legal action may lead to difficulties.

Hi Sir, thank you for your reply. Do I need to inform the HR and the manager of that consultancy that I am coming to get the letter? My brother sent an email yesterday as per your advice, but there has been no reply from them yet. Please advise. The consultancy is based in Bangalore.

Can you please clarify a few aspects of your brother's case?

1. You mentioned that he was working in a software company. Then where does this consultancy come into the picture? If he was on the rolls of the consultancy, please check his appointment letter. Does the HR of the software company get involved if he resigns?

2. Is he currently abroad with the consultancy or the software company? If not, whose rolls is he on now?

Kanna Vijayakumar is correct in stating that pursuing legal action could complicate the case. However, I am unsure if you will be allowed to complete the exit formalities on your brother's behalf. Perhaps your brother can sign, scan the necessary documents, and email them to the concerned officials. That should be acceptable.

Even though you are in Chennai, it might be better to go to Bangalore and meet them face-to-face. This would be more effective than teleconferences or emails. Another possibility to consider is that the reason you mentioned (that they haven't hired a replacement yet) could be just an excuse. The real reason might be different, and only a face-to-face meeting will help you uncover this aspect.

a) The software company is not related to any of my brother's actions since he was under the payroll of the consultancy, and even in the appointment letter, it states only a 30-day notice period.

b) Now, the replacement has already been appointed, and he has been in service for 2 months.

c) My brother is now entirely working for a different company abroad and is a direct employee of the new company.

When he is already working with the new overseas company, why is the issue of a relieving letter coming up now? Also, you mentioned that the consultancy accepted his resignation, subject to the notice period—I assume he served for the full notice period. Suggest to him to show the acceptance to the new company—many companies in the IT sector accept it. Also, ask him to talk to the concerned person—whoever he was in touch with [or working with] in the company where he was working earlier and explain the situation. Usually, since consultancies are dependent on the companies for business, they can't say no when there's pressure from them—especially when it's for legitimate and ethical reasons.

Hi, yes, my brother has submitted the resignation acceptance, but they need a relieving letter as per their company procedure. My brother served a 30-day notice period, but the consultancy claims he did not complete the exit formalities. As you advised earlier, I am going for a face-to-face meeting to address the situation. My brother has been in touch with the concerned HR, who accepted the resignation. He also sent reminder emails asking for updates, but there has been no positive reply. Today, I am going to Bangalore for the face-to-face meeting. Thank you for your help, and I hope for a positive reply from them.

I suggest you meet the consultancy and also the concerned person(s) in the company—project managers, etc.—where he was posted for work by the consultancy. If you don't know, take the names from your brother.

Dear all,

I am new to the HR site. I have recently left an organization; they have given me a service certificate in place of an experience letter and relieving letter. The HR said this works in place of a relieving letter. I was working as an Executive Design Engineer with 3.5 years of total experience. I have attached an image of the experience letter (some portions are masked for safety).

My Questions

1. What is the difference between a service certificate and an experience letter, and which one is better for my post?
2. Will this service certificate work in place of a relieving letter (my new company may require a relieving letter)?
3. Please look at the format of the experience letter attached; there are no sentences. Will this create any impact on my future company where I will join?

This is an urgent post, please reply as soon as possible.
