ESI: Applicable to Insurance Industry Do ESI provisions are applicable to Insurance industry? Is there any circular or judgement related to this?

In my understanding, there is no special exemption given to the insurance industry as a whole. However, if your establishment provides better medical and other facilities to your employees and their family members than what is offered under the ESI schemes, you may be eligible for an exemption from ESI. To achieve this, you must apply and demonstrate to their satisfaction that the benefits to employees are more advantageous than those provided by ESI.

Prior to 2009 ESI act was not applicable to Insurance Industry. There was some judgement in 2009 which made some change. I am not sure that’s why require inputs from HR friends.

Could you please explain why insurance companies fall under the purview of ESI? Do you have any notifications or legal judgments regarding this matter?

I don't have the details with me, but I have seen a letter from the ESI department regarding a survey of all the insurance companies, including LIC and others. This letter was supported by another from the Central Government. So, it's beyond doubt that insurance companies, being in the service sector, would be covered under the ESI Act if they have the requisite manpower and fulfill other criteria.
