Please help me solve this query. I suppose your company must be paying for maternity leave. Just check and tell me how they pay it. I mean, do they credit our salary on a monthly basis during that period or after the completion of the 3-month maternity leave?

Hi,
Payment for maternity leave can be made differently under two conditions:
1) Condition 1: If an employee is covered under ESIC, in this scenario, the organization will grant the leave, and the appropriate government will make the payment during the maternity leave. The payment is made after the submission of Form 23 (After child birth). The government will pay within 30 days from the submission of the form.
2) Condition 2: If an employee is not covered under ESIC, in this scenario, the organization will grant the leave for maternity as per the act, and the payment of salary can be made upon the resumption of duty by the employee.

Payment of maternity benefit is payable during the benefit period only and not after the resumption of duties. It is the benefit extended while the member is on leave on account of maternity. The intention of the legislation is that the employee should not be put to financial hardship during this period.
In my view and to the best of my knowledge, there is no provision for maternity benefit to be payable after the employee resumes duties. If there is such a provision under the act, kindly enlighten me.

Hi GK,
You should contact your local ESIC office to know more. We have 5 employees who are currently on maternity leave, and the procedure I stated above is in line with government officials.

This is a new clarification on PF. As per the act, the contribution for PF is payable only on Basic wages which is as per the contract of employment or as per the appointment order. The maximum wages for which contribution is payable is for Rs. 6500. The minimum basic wages for the purpose of contribution are not fixed. However, the department is taking the view that a minimum of 60-80% of the wage should be basic. There is no law to this effect. Let me have your views.

I will support for payment based on gross pay. This is the time when the employer should compensate their employee at the maximum level. Policies should be framed in such a way that it will be a great help for employees, especially expecting mothers.

When should I take maternity leave? I will complete six months in July at this company. Then, I will receive a confirmation letter from the company stating that I am confirmed with the company.
