I want to know how much salary is paid to an employee during maternity leave. Recently, in August 2016, maternity leave was extended from 12 weeks to 26 weeks. I want to know if the employee is paid just the basic salary during maternity leave or if the employee receives full payment during leave. The recent Maternity Act 2016 Gazette notification file is attached below.
Kindly let me know the payment benefits according to the Maternity Benefit (Amendment) Act, 2016.

1. Sir, the material you uploaded is of a bill and not an Act. The said bill is still to be passed by the Lok Sabha and has not become a law so far.
2. Regarding rates of payments of the maternity benefit under the Maternity Benefit Act, 1961, I hope you will go through the said Act in which the rates of such payments have been mentioned. In case of any doubt, you can ask in this thread with specific points of doubts, if any.

1. Official Gazette Notification has not yet been passed. As of now, it is only 12 weeks.
2. You need to pay 100% of her usual salary (including all components). You also need to deduct statutory compliance such as PF, PT, etc.
Note: For ESI-enrolled employees, there is no need to pay the salary; instead, put LOP for all the leaves. Insist that the employee gets the salary from ESIC.
