I want to understand whether HRA is a part of minimum wages as defined in the MW Act. I understand that HRA has to be 5% of Basic + DA. Please let me know under which notification this has been notified in Maharashtra.
Wages as per the MW Act are inclusive of all allowances. Can HRA be included to arrive at minimum wages?

As far as I know, the Minimum Wages state that a specific amount of money is to be paid. It does not specify that the basic should be the amount mentioned in the Minimum Wages. Additionally, there is no restriction on what the basic pay should be, but overall, the total amount should equal the minimum wages required to be paid based on the category of work.

If anyone tells me that HRA is compulsory and what is the minimum limit for HRA? Also, please provide details of the components of CTC with the minimum limit in Uttar Pradesh and other states. If possible, please send me a good format.

Dear,
Payment of HRA is not compulsory at all. However, in the case of employees receiving salaries at a higher range, we take income tax points into consideration. From an income tax perspective, pay 40 percent as HRA because tax can be exempted on the same.

Understanding House Rent Allowance (HRA)
HRA, or House Rent Allowance, is provided to employees. It is a part of the salary, but employers are not obligated to include HRA as a component of the salary. However, it is considered in the ESI deduction.
