Dear All,

I need to take advice from you on whether we need to seek approval from the Government of India or the Labour Department when we are creating HR policies and procedures. We are a newly established company in India.

Kindly guide.

HR policy is made based on the general rules and acts applicable to your state or organization. Additionally, consider what facilities you want to add from the company's side. For example, leave rules should comply with the applicable acts, such as those governing Earned Leave (EL) or Paid Leave (PL). Short leave options could also be considered. Other aspects to consider include timings, shifts, canteen facilities, and transportation, all while ensuring compliance is maintained.

Dear Rakhi,

There is no requirement to take approval of the Labour Department when you make HR policies and procedures. However, it is necessary that such policies should not be violative of any of the Labour/Employment related legislations.
