How Can We Handle Employees Leaving Without Notice Right After Payday?

I'm working as an HR Executive in an Indian company.

The employees who have been with the company for 6 months or more are required to give a minimum of one month's notice in case they don't wish to continue their services with the company. This clause is clearly stated in the Appointment Letter provided to all employees.

However, employees tend to leave as soon as the salary is transferred to their accounts.

Please advise if the company can take any action against such employees.

If they are not interested in collecting their full and final settlement, you cannot do anything. Alternatively, you can choose to hold their experience certificate and relieving letter and deduct from their full and final settlement. Best of luck in not getting such employees.

The best thing to do is to inform their new company where they have joined that this person has not given prior notice and has not cleared the dues. This is the best thing to do.

Dear Anika,

In my opinion, an HR person can take the following steps:

1) When a new candidate joins your company, he/she undergoes a probation period of 6 months. If the new employee leaves the company during the probation period, they must submit a resignation letter along with payment for the six-month probation period.

2) If a candidate is in the training period for one year and leaves the organization before completing the year, the candidate is required to pay the amount for one year to the company, as stated in the clause mentioned in the appointment letter.

Good question. These types of sufferings are often faced by most of the managements. As said by Ankit Chaturvedi, the new person has to undergo induction training for at least 2 months. Generally, this two-month period will mold the individual according to the organizational culture. If he suits the particular environment, it's okay; otherwise, let him go. There won't be much loss to the organization unless we have to search for another suitable person.

On the other side, we have to analyze what is wrong in the company that makes him dislike the company. This is more important. For this, I suggest there should be an appraisal collected from senior employees of the organization about the general opinion of the organization. This will help in improving the organizational culture.

Can anyone tell me what legal actions can be taken against an employee who leaves the company without submitting the resignation letter and also doesn't follow the notice period criteria?
