Members have time & again submitted that strictly according to the Payment of Gratuity Act, 1972 an employee is not entitled to have gratuity from the employer but at the same time Hon'ble Madras HC have given the Judgement in the year 1996 which was reported in LLR as 1998 LLR 1072 which says that if the employee complete four years & 240 days in the fifth year as per this Act then that person is entitled to get gratuity from the employer.In this situation if the employer do not consider this Ruling then you can approach the Controlling Authority Under P G Act of your area by filing a claim case.
