Understanding Casual vs. Privilege Leave: Do You Need Proof for Casual Leave?

Can anybody tell me the difference between casual leave and privilege leave? Is it necessary by law to submit any documentary evidence by the employee to avail of casual leave? (For example, a medical certificate is needed in case of sick leave.) Please reply.

Hi, The expression "leave" means leave of absence, that is to say, the permission obtained by an employee from his employer relieving him/her from the duty of attending the work with or without pay. There are various types of leaves. Privilege Leave (PL), also known as Earned Leave (EL), is a type of paid leave that an employee earns for the days they have worked, and can avail with prior approval.

First is EARNED LEAVE OR PRIVILEGE LEAVE. The object of earned leave/privilege leave is that an employee should have rest or recuperation from time to time for short spells.

There is another type of leave which is called CASUAL LEAVE. The object of this leave is to enable an employee to attend some urgent or unforeseen contingencies. In addition to that, there is SICK LEAVE which is granted when an employee is unable to perform his duties on account of sickness.

The CASUAL LEAVE is NON-CUMULATIVE while PL is CUMULATIVE. An employee may also avail of PL OR CL during his sickness.

Eligibility conditions are to be seen in the applicable Act under which one is entitled to have Earned Leaves.

Casual Leave Guidelines

As per the Standing Order Central Rules 1946, Section 10, Casual Leave: A workman may be granted casual leave of absence with or without pay not exceeding 10 days in total in a calendar year. Such leave shall not be for more than three days at a time, except in the case of sickness. This leave is intended to meet special circumstances that cannot be foreseen. Ordinarily, the previous permission of the head of the department in the establishment should be obtained before such leave is taken. However, when this is not possible, the head of the department should be informed in writing of the absence and the probable duration of such absence as soon as practicable.

Understanding Leave Types: Earned Leave vs. Casual Leave

Earned Leave (EL) and Privilege Leave (PL) are essentially the same. They are defined under the Factories Act. A person who has completed 240 days of service becomes eligible for EL or PL.

On the other hand, Casual Leave (CL) is governed by the National Holidays and Casual Leave Act. A person is eligible for 7 CL and 7 Sick Leave (SL) per year. EL can be carried forward, but SL and CL cannot be carried forward.
