How Do We Register for a Central Labour Licence for Our Contracting Business?

We are a contractor of Fire Fighting and Plumbing. We are working with various clients in states such as Haryana, Punjab, Delhi, UP, Himachal, etc. We would like your valuable advice on the registration of the Labour Licence. We are interested in obtaining a central license. Kindly, please let us know the procedure for registration and the required formalities.

Dear Mr. Mukesh,

Registration under the Contract Labour Act has to be done by the Principal Employer and not by the Contractor. You need to obtain a Labor License as per the rules applicable to the state.

I just want to know when a contractor is required to have a labor license and the procedure for obtaining a labor license. Can anyone obtain a labor license without actually performing any work?

Contract Labour Licence is required only if 20 or more than 20 persons are working in any calendar month. Form 5 by the principal employer, application filled on form 4 along with muster roll copy which shows 20 or more are working there. If employees are less than 20, there is no need to obtain a license.

After that, The Contract Labour (R&A) Act 1970, Form XXIV Half-Yearly Return to be submitted to Assistant Commissioner of Labour before 31 January and before 31 of July twice in the year.

If a contractor assigns a minimum of 20 or more employees for a contract, then a license will be required. The contractor will need to apply in Form IV along with Form V and L.C.-16, which includes two affidavits. Without any contract, anyone can still obtain a labor license.

Grant of License Application Requirements

Every application for the grant of a license in the regional labour office shall be accompanied by a certificate from the Principal employer in Form No. V. This certificate should confirm that the applicant has been employed or is proposed to be employed by the Principal employer as a contractor in relation to their establishment. Additionally, it should state that the Principal employer undertakes to be bound by all the provisions of the Act and rules made thereunder concerning the employment of contract labour by the applicant.

Sir, if the contractor is providing more than 40 laborers at different places of the principal employer, but at one premise, it is about 5 to 6 (less than 20) and all the sites are in one state but in different districts, does the labor contractor have to take the labor license for all the sites?

- The principal employer is coming under the provisions of the Central Labor Act.
- The contract is given by one contract letter but specifically mentions different sites and the number of persons.
- Bills are prepared individually for all the sites.

My query is: We have an office in Lucknow and Meerut, and we have already obtained the Contract Labour Registration Certificate from the Office of the Deputy Labour Commissioner (C) for the state of Uttar Pradesh. Is it mandatory to obtain a Contract Labour Registration Certificate for Meerut as well?
