Our company's registered office is in Delhi, and we operate from there. Our field workers, who perform pest control, carry out their work in Noida and Ghaziabad. Which Minimum Wages Act will be applicable for their salaries?

Employees working in Delhi will get minimum wages declared by Delhi Govt. & employees (field boys) working in UP state will get minimum rates of wages as fixed by the UP Govt. if your work is covered in any of the schedule employments declared by the UP Govt. under minimum Wages Act, 1948 & the Rules made thereunder.

1. As per you your Company's registered Office is in Delhi.
2. Further,you operate from Delhi and your staffs are visiting nearby areas, which are happened to be in other states.
3. The field boy are performing pest control work in Noida and Ghaziabad (areas under UP state) being in Delhi office rule.
4. Therefore, the Minimum Wages Act of Delhi will be applicable for payment of wages & salaries.
5. Because your staffs are enrolled in Delhi and doesn't have a separate office in operating States.

In facts of this case, if your all the employees are enrolled at your Delhi office & the field boys are being sent to UP state area then in our opinion you are to pay minimum rates of wages as declared by the Delhi Govt. For sending the employees on duty at any other place which is not their regular place of working then you are to pay TA/DA to them.

The minimum wages of the state is applicable,in which the employees are enrolled in the Workmen Register. In your case;
1. Your Company's registered Office is existing in Delhi.
2. Further more,you are operating from your Delhi office. And your staffs are catering sevices of pest control work in Delhi NCR (Noida & Ghaziabad) areas, which are happened to be fall under state of UP.
3. The field boys are performing pest control work in Noida and Ghaziabad (areas under UP state) being enrolled in Delhi office roll.
4. Therefore, the Minimum Wages Act of Delhi will be applicable than of UP for payment of wages & salaries.
5. This is because of your staffs are enrolled in Delhi Office and you don't have a separate operating office in UP States.
