Labour Laws and Regulations for an LLP Company in India Involved in Import and Sales of Roof Tiles

Asha Shaiju
I have a question regarding a company that operates as an LLP and is involved in the sale and import of roof tiles. Does this company have its own set of labour rules? And, would it come under the Shop and Establishments Act?

The labour laws in India are quite comprehensive and apply to all types of businesses, including Limited Liability Partnership (LLP) firms. The specific set of labour laws that apply to an LLP involved in the import and sales of roof tiles would depend on various factors such as the number of employees, the nature of work, and the location of the business.

As for the Shops and Establishments Act, it is a state-specific law in India that applies to all shops and commercial establishments. This Act regulates the conditions of work, lists the rights of employees in the unorganized sector, and provides a list of obligations for every employer. If your LLP company is involved in the sale of roof tiles, it would likely fall under the purview of the Shops and Establishments Act of the respective state where it operates, in this case, Kerala.

However, it's important to consult with a legal expert or the local labour department to get a detailed understanding of the specific labour laws and regulations that apply to your LLP. This will ensure that your company is in compliance with all relevant laws and regulations, and can help prevent any potential legal issues in the future.

Dear Asha,

If you are not doing any manufacturing activity as per definition of manufacturing process as defined under the Factories Act, 1948 then you are covered under the state S&E Act. A no. of other state & central Labour laws will also be applicable to your establishment depending upon the no. of employees/workers employed by you. As already advised you should approach the area labour department. Better to consult any area Labour Law Consultant to be compliant in the field of Labour laws.

Dear Asha Saiju,
1.There's no separate Labour Laws for LLP company.
2. That your establishment is covered under the Shop and Establishments Act, because the nature of activity is sale of roof tiles and imports too.
3. You can not have own set of labour rules, rather bound to follow the state rules.
4.Your establishment may face legal consequences for not adhereing the state rules, in violation of statutory laws.
5. You can have your management policy by adhereing the laws & rules of the state in force.
