Seeking Guidance on Displaying PF Form 5A on Notice Board or Company Website as per Recent Changes in PF

N.Mohan
Hello Everyone,

According to the recent modifications in the Provident Fund (PF) and the subsequent circular issued, it is now required to display Form 5A on the notice board or the company's website. Most of the details that need to be displayed are already mentioned and displayed as required under various other labour laws such as the Factories Act, Shops and Commercial Act, etc. In this context, can we seek permission from the Employees' Provident Fund Organisation (EPFO) for exemption since these details are already present on the notice board? Of course, any details that are not available can be added. I would appreciate your advice on this matter.

Best Regards,

Hello N Mohan,

In response to your query, yes, it is possible to seek an exemption from the Employees' Provident Fund Organisation (EPFO) if the details required in Form 5A are already displayed as per other labour laws. However, it's important to note that the EPFO will make this decision on a case-by-case basis.

Here's a step-by-step guide on how you can proceed:

1. Review the details displayed on your notice board and compare them with the requirements of Form 5A. Make sure all the necessary information is already present.

2. If there are any missing details that are specific to Form 5A, add them to your notice board or company's website.

3. Write a formal letter to the EPFO explaining your situation. In the letter, mention that the required details are already displayed on your notice board as per other labour laws. Request an exemption for displaying Form 5A.

4. Submit the letter to the EPFO and wait for their response. It's crucial to continue complying with the current requirements until you receive an official exemption from the EPFO.

Remember, it's always a good idea to consult with a legal expert or HR consultant to ensure compliance with all labour laws. This will help you avoid any potential legal issues in the future.

Along with a number of other notices/abstract of the applicable enactments which are required to be displayed/exhibited at the notice board you can also display Form V under EPF Act.

Form 5A is not actually an abstract of EPF and MP Act but it shows who is responsible for payment of contribution etc. It is available in the employer portal itself. You can take it from the "Establishment" field under "Form 5A" You can also fill in the attached proforma and put it in the notice board.
