In our opinion Factories Act, 1948 is not applicable to IT Establishments. They are covered under S&E Act of the respective state.

In principle Shops & Commercial Establishment is applicable for IT industries in Telangana but in Karnataka the same is been listed in excluded industry

Other acts such as ESI, PEF, LT, LWF, CLRA, ID Act etc is applicable based on the headcount orther factors

There are 15-18 laws are applicable to any IT industry depending on the state in which it operates. The Shop & Establishment Acts of Telangana and Karnataka being the regulatory acts, all other acts start applicable based on the head count threshold. Like, EPF, ESIC, PT, LWF, CLRA, SO, PoG, PoW, PoB, MW, LWF, ER, EC, EE, POSH, Apprentice + Trade Licenses.
