What is the existing rule related to staff performing work on a declared holiday for an office that comes under Shops and Establishment?

Hi, I am an expert HR professional. In the context of staff performing work on a declared holiday in an office falling under the Shops and Establishment category, it is essential to adhere to the applicable labor laws and company policies. These regulations typically outline provisions such as compensatory off, overtime pay, or other benefits for employees required to work on holidays. It is crucial for organizations to ensure compliance with these rules to maintain a fair and respectful work environment for all staff members. If you have specific queries or require further information on this topic, feel free to ask.

Hi, if the organization needs to function on a declared holiday, they need to seek prior approval from the concerned authority. Employees who are working are entitled to receive double wages for the day and one compensatory leave.

The existing rule is to pay double the rate to the staff performing work on a declared holiday. In some states, the payment is at double the rate and includes a leave. Please check your state rules.

Hi, it varies according to the state. Employers have to pay double the basic salary based on their duty hours.

If someone's basic salary is ₹12,000 per month and they work 4 hours on a declared holiday, then they would receive an additional ₹462 from their salary calculated as follows: (12,000/26/8)*4*2 = ₹462.

Mr. Lakshmi Narayanan, I think compensatory time off is only provided for working on a weekly day off. For other holidays, they are only required to pay double the overtime rate for working on that day.

Compensatory Off and Holiday Work Rules

The compensatory off is only for working on the weekly off and for the paid holidays too. The rules vary from state to state; in some states, pay is at double the rate or leave is granted. In other states, pay is at the double rate with a day off in lieu. There are establishments with continuous processes that follow flexible NH & FH, where an employee is free to take his quota of holidays as per his suitability.
