Is There a Law in India Mandating HRA at 40% or 50% of Basic Salary? Let's Discuss

Hi, I just want to know if there is a law in India that enacts HRA at 40% or 50% of the basic salary of the employee.

House Rent Allowance (HRA) in India

In India, there is no specific law that mandates a fixed percentage for House Rent Allowance (HRA) as a portion of an employee's basic salary. The percentage of HRA can vary depending on the employer's policy, the city in which the employee resides, and other factors. It is usually agreed upon between the employer and employee as part of the employment contract or company policy. It's essential to refer to the specific terms and conditions outlined in the employment agreement or consult with the HR department for accurate information on HRA entitlements.

There is an HRA Act in some states such as WB and Maharashtra, where the state act stipulates 5% HRA on Basic & DA.

The 40% OR 50% is as per IT rebate and has nothing to do with the HRA Act.
