I work in a construction company where CLRA, BOCW, ISMW, Payment of Wages Act, Bonus Act, Gratuity Act, and other relevant acts apply. The Factory Act is not applicable. While reviewing the wage records of contractors, it has been noted that they only pay for days worked and do not compensate for weekly offs, such as Sundays. They claim to be following the minimum wage rates specified in the notification. Could someone please assist by providing references for the mentioned acts? I can supply the necessary information.

Payment for Weekly Off Days in Construction

Construction employees, if paid on a daily basis as per the Minimum Wages Act or above, do not need to be paid for weekly off days. If they are paid a monthly rate, then the payment will automatically include the compensation for the weekly off days. The concept is "No work, no pay."

Contractors are bound by the law to pay for holiday work if an individual works on their weekly off day. The contractor's establishment must declare any day of the week as the weekly off day. It is important to note that the payment register is prepared for the working days, and working on the weekly off day is considered overtime work, with the rate being double the rate of an ordinary day.

Minimum Wages Notification Explained

The Minimum Wages Notification provides both daily and monthly wage information. The daily wage is calculated by dividing the monthly wages by 26.
