Notice Period Dilemma: Should Holidays and Weekends Count in the Last Working Day Calculation?

Poonamshj
Are we considering holidays and weekly offs as well in a 1-month notice period when providing the last working date to a particular employee? Please revert.

Hi, Yes, the notice period should include the week off, national holidays, and festival holidays. You cannot demand 30 compulsory working days.

The practice of considering holidays and weekends when calculating a notice period for an employee's last working date can vary depending on the company's policies and local labor laws.

Hi,

In this perspective, it is clearly understood that the employees and HR department do not have a clear policy about the notice period. As soon as the employees submit their resignation, after acceptance, their notice period starts. The notice period is nothing but the obligation of the employee to fulfill their duties to complete the other formalities. During this period, holidays and weekly off days are naturally calculated and included in the notice period. Even employees can work on holidays and complete their remaining tasks.

Holidays and weekly offs are privileges given by labor law, and employers cannot curtail them.
