Facing Sudden Job Transfer and Termination: How Can I Legally Protect Myself?

Dear Sir, Please advise me. I am working in an insurance company in Jamshedpur, Jharkhand. My performance was good, but my reporting boss is very arrogant. He sits in the Head Office in Jaipur, Rajasthan. He made an arrangement with HR and transferred my job to the Head Office in Rajasthan with a short notice period of one and a half days to report to the new location. He sent me an email on 02.09.2023 at 2 P.M., which was a Saturday, a half-day working in our office. I left the office at 1:30 P.M. Now, when I came in on Monday, I saw the email. I immediately replied and requested at least 15 days to join the new location, but they never responded to the email. Today, they sent me a termination letter. They also withheld my salary; the usual credit date of the salary is every 5th of the month. Now, how can I take legal action against them? Where should I approach for legal action?

Presuming you are covered as a workman under the Industrial Disputes Act of 1947, this is a fitting case to challenge the termination as per the Act, and there is every hope for success. You may need to approach the Labour Officer/Central and seek their intervention in the first instance. Afterward, you can initiate legal proceedings and consult a locally available competent advocate specializing in labor matters.
