Notice Period During Probation: Do I Really Need to Serve It if It's in My Contract?

Is it mandatory to serve a notice period during the probation period if a one-month notice period clause is mentioned in the appointment letter? Please advise.

Yes, if the same is mentioned in the appointment letter, you need to follow the employment terms and conditions.

Hi, yes, a one-month notice and proper handing over of work is mandatory irrespective of the appointment terms. One can't just vanish from the workplace one fine morning.

Shop and Establishment Act Maharashtra

The Act does not specify any requirements for notice periods for resignation or termination of employment. Employers can prescribe notice periods in employment contracts as they deem fit. Hence, if a one-month notice period is mentioned in the appointment letter and has been accepted by both parties, then it should be honored.
