Seeking Justice: Can My Hearing Day Be Counted as a Duty Day for Service Harassment?

Sudesh Kumar
I am a government employee.

I have placed my matter of service harassment with the SC Commission. My department is forwarding all my communication to the SC Commission.

Whenever I go for a hearing in the SC Commission, I have to submit a leave application to my department.

I have requested that the day of the hearing be considered as a duty day since I am seeking redressal against service harassment, and all my communication is being forwarded by the department.

Please help me understand this situation and provide me with any official memorandum from the Department of Personnel and Training (DoPT).

There is no right or policy providing for treating appearance in such Commissions as being on duty. There are instances where the Commission has directed that the employee's absence should be treated as on duty. You will have to make a request to the Commission for such a direction. Do it in the next hearing; most likely, the Commission would oblige.
