Can Employees Outside ESIC Coverage Still Claim Benefits? Seeking Advice from Seniors

rajeshnairkbr
Hello Sirs/Seniors, can anybody suggest whether an employee who was previously covered by ESIC but is currently outside the coverage limit can still claim ESIC benefits?

Hi, Obviously, when the employee is out of coverage, he/she cannot claim ESIC benefits. However, if an employee's salary increases during the middle of the contribution period (April to September & Oct to March) to the extent that he/she exceeds the ESI ceiling salary, then the employee must continue to contribute to ESI until the end of the contribution period. The employee is also eligible for ESI benefits until the end of the contribution period.
