If an employee avoids or refuses to accept any letter from management, it can be considered gross indiscipline, and such an act can be termed misconduct.

Hi, if the confirmation letter is not accepted by the employee, then he will continue to be on probation. The employee has two options: either to accept the confirmation letter or to submit a resignation.

This is a somewhat unusual case wherein an employee does not want to be confirmed. Typically, employees strive to attain confirmed status and may become anxious if they do not receive a letter confirming their employment.

Why is the employee refusing to accept the confirmation letter?

Have you or anyone else spoken with him/her? What is his/her reasoning for declining it? Does he/she intend to resign from the company? Is there a distinction in the notice period between a probationary employee and a confirmed employee? Is it possible that he/she believes by not accepting the confirmation letter, he can remain a probationer and thereby leave the possibility of exiting open?

Regardless of the confirmation letter, as per the provisions of the standing orders, it is mandatory for employees to acknowledge official communications. Refusal to do so constitutes misconduct. Therefore, the administration of your company retains the right to take disciplinary action for this misconduct.
