Resignation and Reinstatement: Is It Possible to Handle Both on the Same Day?

rahulagg2@gmail.com
Can reinstatement and relieving from services be on the same day?
Can a composite order in one letter issuing reinstatement of the employee as well as accepting his resignation be issued, although reinstatement is part of disciplinary proceedings while resignation is part of other service regulations?

Dear Rahul, The replies to your questions are as below:

1. Theoretically, yes, but please provide us with the context for both, i.e., reinstatement and relieving from the service.

2. Resignation and reinstatement from service are both independent of each other. Whether to issue a composite order or to club it in one letter will depend on the situation. If two letters are issued, then while issuing the second letter, a reference to the previous one may be quoted.

The reinstatement and resignation, as clarified by the learned Dinesh Sir, can be issued on the same day, preferably with reinstatement in the forenoon and resignation accepted with effect from the afternoon of the same day. Issuing a composite order can lead to multiple interpretations, suggesting that reinstatement was a farce, merely to circumvent mandatory orders to this effect.
