Do all Presiding Officers & Members of Internal Committees realize that they are also 'Judges'?
Hon'ble Delhi High Court, in their Judgment of the year 2021, upheld that the Presiding Officers & Members of Internal Committees are also 'Judges' and propounded that the "Principles of 'Security of Tenure'" which apply to Security of Tenure of Judges and Presiding Officers of various Quasi-Judicial Tribunals would also apply to the Presiding Officers and the Employee-Members as well as the Non-Employee-Member (External) of Internal Committees, throughout India.
The Delhi High Court clarified that the word "Judge" denotes not only every person who is officially designated as a Judge but also every person who is empowered by law to give, in any legal proceeding, civil or criminal, a definitive judgment, or a judgment which, if not appealed against, would be definitive, or a judgment which, if confirmed by some other authority, would be definitive, or who is one of a body of persons, which body of persons is empowered by law to give such a judgment.
The significance of the judgment
This telltale judgment is bound to serve as a beacon light for employers as well as the Internal Committees; therefore, we, the Kritarth Team of Special Educators PoSH Mandatory Programs, earnestly "beseech" all Presiding Officers and all Members of all Internal Committees to "rise up to the standards of Hon'ble Judges of Our Judiciary and Tribunals and uphold the sanctity of this Independent Body, Entity/Forum/Institution."
