How to Update PF Exit Date for My Late Father Who Passed Away During Leave?

I am Arjun Kumar, and I have one issue, i.e., my father had PF, but now he has passed away. I'm inquiring about his PF status - there is no date of exit, and he died on 12.01.2022. Prior to his passing, my father took a leave from the company from 07.12.2021 to 07.01.2022. Even though the leave period was over, he did not return to work and unfortunately passed away at home due to a heart attack.

When attempting to update the PF date of exit as the date of death, the request was rejected in JD. The reason for rejection was that the PF record showed the last contribution month as 12.2021, with non-contributory days totaling 24.

Therefore, I am seeking clarification on the appropriate current exit date given that he was on a one-month leave and also confirmation that the reason for exit should be marked as "death." My question pertains to whether this situation should be considered an exit while in service or under different circumstances.

In your post, you mentioned that "Before that, father took a leave from the company from 07.12.2021 to 07.01.2022." You have not specified whether this leave was without pay or if he utilized earned leave/privileged leave that was in his balance.

If he took leave without pay, the final exit date can be considered as 07.12.2021. If he took leave with pay from the company, you can indicate the final exit as the date of death.

Exit Date Consideration for PF Benefits

Even if he was on leave without pay, the date of exit should be a date after the date of death. If you put any date prior to the date of death, you will not get the benefits of EDLI, which is available only to those who die while in service.

So, if you put 7/12/21 as the exit date, then the death will be considered to have occurred after he had left the service. However, if you mark the leave days as NCP and put 13-1-2022 as the exit date, it would be construed as death while in service.

PF Contribution and Exit Date Issue

The father received pay on PF for the month of December 2021, which marked his last contribution. On the 7th of December, he was on leave, accounting for 24 NCP days in that month of contribution. I have submitted a PF rejection letter citing a mismatch in the date of exit with the date of death, which was on 12.01.2022.

In the ECR challan, the name listed is KRISHNA BAHADUR. However, an issue arose as the last month's wage for December 2021 was paid on the 13th of January 2022.

The employer of your father has committed a serious error. They should have kept Bahadur in the RCR of January as well. It should be non-contributory. Now you have to get the documents called for. In the muster roll, there should be the name, i.e., Krishna Bahadur, as leave without pay (LOP) till 12th January with stroke remarks from the 13th onwards. Ask them to make a muster roll if they already have one without his name in it. It may happen that they missed it out since it is the starting month. If so, insist on them to make a revised one and get the payslips also prepared with leave without pay marked till the date of death. This will establish that Krishna was in service at the time of death. That only makes him eligible for EDLI, though for pension benefits and PF withdrawal benefits, these are not issues.
