Promotion Letter Delayed: Can I Legally Challenge My Company for Withholding It?

The company is not giving me my promotion letter. Can I take any legal action against the company?

What was your designation before the promotion, and what is the designation after the promotion? On your promotion, has your salary been increased? When did you get the promotion? Is issuing a letter to a promoted employee a common practice in your company?

Additionally, who did you approach for the issuance of the letter? What correspondence have you done? What is their take? After the promotion, does your monthly payslip mention the higher designation?

Please provide complete information so that the members of this forum understand your problem correctly.

Quick guidance is not to pursue legal action. This is not a matter fit for litigation. If the payslips are being issued with the higher designation, then get a sign and round seal endorsed on the payslips. This compromise should suffice for the purpose.

Dear sir, I joined as an SRM and received my first promotion with a promotion letter provided by the company. After some time, I received another promotion with a promotion letter sent to my official email ID. During the pandemic, the company closed all the managers' official IDs. In October 2020, I received my third promotion but did not receive a promotion letter. When I inquired with my senior managers, they advised me to wait. On April 1, 2021, I received yet another promotion, but again did not receive a promotion letter. When I approached the senior manager, he mentioned emailing regarding this issue.

I have discussed this matter several times with my senior manager, who consistently responds the same way. Eventually, I resigned, and the company provided an experience letter stating my last designation.

Upon joining a new company, the HR asked for proof of my last increment. When I consulted my senior manager, he advised me to speak with HR after my resignation. I have sent numerous emails to HR, around 14-15, and received a reply stating that they do not have any promotion letters. Following this, I sent more emails, around 10-12, with evidence, including dates and screenshots. I have also made numerous phone calls but have not received any response. In my latest email, I requested the HR to provide proof of my last CTC.

Sir, could you please suggest what steps I can take to obtain the proof I require? Thank you.

In your long reply, you did not mention anything about adding your designation on the payslip. I had inquired about this in my previous message as well. Based on the information on the payslips, you should request your ex-company to issue a "Career Certificate" detailing the promotions you received during your tenure with them. It is important to ensure that the certificate is signed by the Managing Director (MD) of the company.

If the company did not mention the designation on the monthly payslip, it shows how unprofessional they were. You could have left the company long ago.

Anyway, as suggested in the previous reply, visit your company. Talk to HR and also the MD of the company. Make an earnest plea for the issue of the "Career Certificate." In the certificate, they should mention designation-wise breakup of your tenure with them.

By chance, if the company shows apathy or even hostility, remain calm. Do not lose your composure.

Before you visit your ex-company, ask them to issue a letter to you to furnish details of the promotion or the "Career Certificate." A letter from the current company will lend weight to your request.
