Are Paid Weekly Offs a Legal Requirement? Seeking Clarity for Our Company Situation

I am working in a spinning mill in a public sector undertaking company. I have a question about paid weekly offs. Is there any law regarding paid weekly offs? Currently, we are not receiving paid weekly offs in this company. Is it mandatory by law to have one paid weekly off after six working days? Please reply. Thank you.

If you are being paid minimum wages as per the Government-notified rates, then the weekly off is included in the payment. Indeed, the minimum wages for one day as per the government notification actually represent wages for one and one-sixth day. Therefore, in every six days of wage payment, an employee receives seven days' worth of payment. The daily wage is derived by dividing the monthly wages by 26.

Regarding your query on the legal provision for paid weekly offs, please refer to Section 52(1) reproduced below:

(1) No adult worker shall be required or allowed to work in a factory on the first day of the week (hereinafter referred to as the said day), unless

(a) he has or will have a holiday for a whole day on one of the three days immediately before or after the said day.

Weekly Rest Day Requirement

What I require is to grant 24 hours of rest after six days of working. It is not necessary that the weekly off should be a paid day. The statutory average wage (minimum wage) for a day is calculated considering the weekly off, and that is why the monthly wage is divided by 26 to get the daily rate.

I am curious as to how you are saying you are not paid for weekly time off. Please let us know the computation you are referring to.
