Dealing with Employee's Death: Are His Parents Eligible for Pension After 2 Years of Service?

mehta-prashant
My employee has passed away while on the job, and he was unmarried. Now, I want to know if the employee's parents are eligible to receive a pension considering his service was not more than 2 years. I have attached his PF passbook for reference.

Dear Mr. Thakar, I trust you have obtained the nomination in Form II while enrolling this deceased employee.

Secondly, to answer your question, it is "Yes," the dependent parents are eligible first to the father and then to the mother upon the father's death. You need to apply in Form 20 & 10D along with the relevant documents as necessary supporting documents. Besides, he would also be eligible for EDLI, which can be claimed by applying in Form 5IF. All these need to be submitted offline.

The documents required would ideally comprise the Legal Heir Certificate, Death Certificate, joint photograph of the claimants, and a copy of the cancelled cheque.

I hope you find the information useful.

Regards, AG.

Yes, deceased employees' parents are eligible to receive PF/pension amounts. For proof, a legal heir certificate needs to be attached.
