Facing Relocation Benefit Denial from MNC: How Can I Legally Pursue My Rights?

bibhudatta-ardu
I was working with one of the MNCs in Oil & Gas for 13 years, and although it is laying off employees, they asked me to resign, which is fine. However, there is a relocation benefit that should be provided as per my appointment letter. Due to the impact of the coronavirus and my children's schooling, I was unable to travel in 2020. We finally moved on April 2nd, 2021, after the school exams were completed. Initially, the company agreed to provide the relocation benefit, but now they are not communicating with me nor responding to my inquiries.

Seeking Legal Advice for Relocation Benefit

Please suggest what actions I can take through the labor court or any legal means. The company has more than approximately 4,000 employees in India and is a multinational corporation.

Clarification Needed on Resignation and Relocation

The facts are not clear. If you have already resigned, what is the need for relocation? What do you want to challenge - the layoff, resignation, or relocation? Please provide clarity before a response is given.

Relocation Benefits on Resignation

Relocation is given for moving on resigning from the job (will need to see your exact wording of the letter).

Since you did not relocate at that time, you are not entitled to it. You can't claim it after a year.

How much is the amount? I am assuming you are not a worker under the law, and therefore you will have to file a case in court. Is the amount worth fighting?

Pandemic Impact on Relocation

The present pandemic situation, in my understanding, is more than an adequate explanation for the delayed relocation. Even the provisions of the Limitation Act have been kept in abeyance during this period. You may consider highlighting these aspects. If there is no positive response, you can initiate legal action. If you are not a workman, you may have to go to a civil court.
