Hi, I joined the company 20 days ago, but due to my health issues (pressure), I can't continue any further. I am on probation period. Do I need to serve the notice period? I have not received any salary to date.
Please refer to your appointment orders. If any notice period is prescribed, you either have to serve it or buy it out by paying the notice salary. As only 20 days have passed since you joined and the reason for your resignation is medical grounds, alternatively, you can request a waiver of the notice period. However, it is solely at the discretion of the employer.
It is mandatory to serve the notice period if a clause is provided in your appointment letter. If such a clause exists, you can request the management to waive or allow you to buy out the notice period by providing a medical certificate of your health.
In continuation of this post, I have a query. If the employee does not pay for the notice period and just walks out of the job, what legal actions can the company take against the employee and through which authorities?
