Fired Without Notice After Asking for My Salary – How Can I Get My Dues?

My employer has refused to give me my salary after working onsite for one month. When I raised the issue and asked them to pay my dues, they fired me without any notice. I requested them to clear my dues before I leave the organization, but they behaved rudely and even threatened me. I would highly appreciate any help in getting my salary. Thank you.

Claim for Reinstatement with Back Wages & Continuity of Service:

If you were employed in the capacity of a workman, you should file a dispute under Section 2-A(1) of the ID Act, 1947 against the employer before the Labour Officer/ACL for the area where you last worked.

Claim for Unpaid Wages:

Simultaneously, if your last drawn salary was Rs. 24,000 or less, file a claim under Section 15(1) of the Payment of Wages Act, 1936 before the DCL for the area. If it's more, file a claim under Section 33-C(1) of the IDA before the Labor Court for the area.

The claim under Section 33-C(1) should be filed with the Secretary to the Government, State Labor Department (Not Labor Court).
