No Salary Slip, No Appointment Letter, No Offer Letter - company forces them to leave and they don't pay them

rashmi-poojari
Recently 3 months back I have joined a Software company as they have not given any Offer Letter /Appointment Letter /Salary Slip from August 2020

Whenever I ask for a salary slip HR just says that we Consultants who are outsourced who do work for us - and she just ignores it.

HR of the company is the wife of the CEO of the company and she doesn't know the company rules and regulations. They deduct salary every month and they are not showing any deduction if they are deducting for PF then should have signed the PF form which has not been done and informed us.

As I have joined this company in these 3 months 2 employees left and they are not paid, when the salary day comes they try to torture all Employees and force them to leave the company and they don't pay them. I need some help regarding this issue.

Dear Rashmi,
When one reads the posts of this kind, one gets a feel that labour rights in India are still in primitive stage or whether labour laws exist or not. The new labour codes have been declared with much fanfare. But will these codes address the real issues of the labour that remains to be seen.
I recommend you approaching labour office of your area. File a complaint there. If possible let the existed employees also file the complaint. All this hopefully should work.
If you face any problem, then approach this forum once again.
Thanks,

Dear Rashmi,
If what you described is true, it is total violation of the existing labor laws and blatant unfair labor practices adopted by the said software company. At the same time, your post gives rise to some valid questions to be answered by you in detail.
1) If no appointment orders, how the employees got into the company?
2) How the salaries are disbursed - just in cash?
3) Why no employee including those left lodge any complaint with the labor department so far?
4) Whether no officer from EPF or State Labor Department visited the company so far?
