Please advise if an organization covered under the Shops and Establishment Act wants employees to work on 15th August. Is it mandatory to pay employees double the wages along with a compensatory off, or does either of these need to be given?
The organization is registered in Noida, and the employees being asked to work on a national holiday are based out of their office in West Bengal. Please advise.
When working on a national holiday, you need to adhere to the state rules of the location where you are working. Of course, you also need to comply with the National & Festival Holiday Act.
The national holiday is a paid holiday, meaning the employee will be off duty and yet will receive the salary for that day. If an employee works on a national holiday, it means they have earned a day's salary. In addition, the holiday should be given on another day, or the employee should be paid in lieu. Therefore, if an employee works on a holiday, they are entitled to be paid double the rate per day.
