Facing False Background Checks from a Past Employer: What Can I Do Now?

I have a total of 9 years of experience in 4 companies - A, B, C, and D. Company B always creates problems whenever an employee wants to leave the company. They hold three months' salary, and they were deducting EPF but not depositing it into employees' EPF accounts.

Many employees and I have made complaints against the employer. The EPFO has already taken action against the owner. However, since legal procedures in India take a longer time, he is providing false information about me in the background screening of other companies.

I have informed one big MNC about this with all the evidence, but they did not consider my point. Instead, they asked for positive feedback from that employer.

What can I do now, and what options are left for me?

How many previous employments are checked in background verification?

Many companies check all the company's records with which you have worked, while some only check records with the last three companies. Therefore, it depends on the specific company's policy.

A positive response from the majority of companies will overshadow any negative feedback from a minority of companies, so it's best to remain hopeful.

Employment Verification Process

Employment verification conducted by any BGV company usually covers 2-3 previous employers. However, some companies insist on complete employment verification.

A lot of employers consider a BGV in totality. This means one single red flag is not viewed in isolation. Your entire feedback from all your previous employers, along with other verifications like ID, income, criminal, and address, is taken into account while making a decision.

Filling the BGV Form

My suggestion is, while filling up the BGV form, include all the details regarding your Employer B. Submit copies of the complaint you had raised regarding EPFO. Since you have mentioned that significant action was taken against the employer, if you have any proof (preferably legal) of that, please submit it.

Any tangible information or complaints regarding this employer should be submitted.

Most employers would understand your situation and take a comprehensive view of the BGV report.
