Flag Hoisting in Private Companies: Can Your Salary Be Deducted for Missing It?

Abhijit Vichare
Dear all,

Greetings!

I seek advice on flag hoisting rules applicable in private companies in India. Is it legal to deduct salary for not attending the flag hoisting ceremony organized on the private company premises?

Kindly elaborate on the rules applicable for flag hoisting. Do these rules apply to all industries, or are some industries exceptions to these rules, such as the hotel industry?

Dear Abhijit, there cannot be a trade-off between salary disbursement and attendance at the flag hoisting ceremony. Both are independent of each other. Linking them is beyond the purview of the law.

People attend the flag hoisting ceremony out of warmth and intensity towards the nation. Imposing a compulsion on attending the flag hoisting ceremony would kill the spirit behind it. Punishing anyone is out of the question.

Why have you raised the query? Are you from HR, and has your management instructed you to deduct the salary of the employee who did not attend the flag hoisting ceremony, or did you not attend the ceremony, and now you fear a salary deduction? What is the exact position?

Thanks,
Dinesh Divekar
