Can My Friend Face Legal Trouble for Joining a Competitor After Quitting His Job?

Query about joining a competitor company

I have a query regarding an employee who joined a competitor company after quitting his current job. One of my friends has resigned from his current employer. He received an email from the company requesting an explanation within 48 hours. According to the offer letter, there is a clause stating that after leaving the company, he won't be able to join a similar company before 2 years. If he does so, he would need to pay 24 months' salary as compensation. He has 15 years of working experience in his field. The company has been promising him a promotion for the last 3 years, but they have failed to fulfill it, even this year. Is there a possibility of such a situation arising? Can a legal case be filed against him for joining a competitor firm? Please help. He joined a new company only 2 months ago.

Dear Rgvb22, the subject comes up for discussion repeatedly. Anyway, you may click the following link, which is about the ruling by the Delhi High Court: https://www.citehr.com/571397-delhi-...n-compete.html

As of now, there is no need to file a legal case. Just show the newspaper clipping to HR if they ask for it. Tell him to keep quiet until he receives a notice from his past employer.

Lastly, the spelling and grammar of your post are far from satisfactory. There are a large number of members who take pride in quality writing. Consider the jarring feeling they might experience while reading your post. Therefore, the request is to maintain the professional standard of your posts.

Thanks,
