Stuck Waiting for My Final Settlement: What Legal Steps Can I Take Now?

kalyankumar-ganesan
I worked with an organization that hires employees for their clients (client-based working). During Jan 10th, I received a request for rebadging from the client. Subsequently, I informed my organization about the request, and they instructed me to complete the final exit formalities on February 1st, 2019. I received my relieving letter on the same day.

While I was still with them, I inquired about the turnaround time for my Full and Final settlement. They assured me that as per their policy, it would take a maximum of 60 days, but they promised to complete it within 45 days. However, it has been 78 days since then, and despite my follow-up emails, I have not received any response from them.

Please advise me on how I can legally address this issue.

Dear friend,

I recommend that you write a letter to the Managing Director of the company. Be polite and request to clear your dues. You may mention that you are facing some family problems and require the money urgently. After writing the letter, wait for 15 days. If no action is taken, then please come back to us. We will guide you on the next steps.

Thanks,

Legal approach is only advisable when all other means have been exhausted. Expenditure on legal proceedings may surpass the total inflow due to FnF proceeds. Time can also be lost, and there are no guarantees of winning in court always.

As esteemed member Dinesh suggests, write a polite letter to the Managing Director requesting intervention for the release of FnF. This step should be taken if you have already engaged with lower levels and have not received a suitable response.

Dear Friend,

This is the right way as suggested by Dinesh Ji. Firstly, you should try to resolve this matter with management in a written way. Legal processes should be the last resort for this situation.
