Am I Running a Factory or a Manufacturing Unit with My Two Gurgaon Operations?

I have two units in Gurgaon. In one, I create hampers for sale, and in the next, I do labeling and packaging. Please advise if we would fall under the Factories Act or as a manufacturing unit?

Dear Aakriti, please go through the definition of the manufacturing process under the Factories Act, 1948, which is provided below for your ready reference. If you are employing 10 or more workers, including contractor workers, and are using power, then you are covered under this Act.

Definition of Manufacturing Process Under the Factories Act, 1948

Sec 2(k) "manufacturing process" means any process for:

- making, altering, repairing, ornamenting, finishing, packing, oiling, washing, cleaning, breaking up, demolishing, or otherwise treating or adapting any article or substance with a view to its use, sale, transport, delivery, or disposal; or
- pumping oil, water, sewage, or any other substance; or
- generating, transforming, or transmitting power; or
