Are Your Work Hours in Gurgaon Legal? Understanding Labor Laws for Service-Based Jobs

Hi All, I want to understand the legal working hours for an employee in a service-based industry in Gurgaon (Analytics Company). Nothing of the sort like work hours is defined in the offer letters; it just mentions about 45 hours a week. Also, if we are made to work 13 or 14 hours a day (we were told it happens once a month or a year, but in reality, it happens almost daily), we aren't paid a single penny for overtime working hours, but the company is ready to deduct the money in case of a shortfall from 45.

So, I want to understand if some sort of working hours are defined in the Labor Law and if I can approach HR regarding the same.

The state act in which the unit is located will be applicable. So, if it's Gurgaon, then the Haryana act would apply.

In your case, the Punjab Shops & Commercial Establishments Act, 1958 as applicable to the state of Haryana will be applicable.
